Mediation is a way to resolve divorce issues outside of court. The approach involves a mediator who makes sure both sides are heard, who keeps the discussion focused, and who helps the two sides reach a mutual decision.

An Alternative to a Litigated Divorce
Massachusetts supports mediation in child custody cases, believing that two parents can reach a better decision than a judge as they have better knowledge relative to the needs of their child. Mediation can also be used to attempt to resolve any issue that arises in divorce, including marital property division, alimony, child support and visitation.
Mediation is an alternative to having a judge decide the issues in your case. When you take a case to court, you cannot be assured what the outcome will be. Mediation puts the outcome in the hands of you and your spouse. Even if you don't get everything you want in mediated agreement, you may like it better than a decision a judge imposes in court.
The outcome of mediation is not binding on either party. This means that you can proceed to litigate your case in court if you do not reach a successful mediated outcome.
